A suspended sentence is your one chance at redemption. If you come up for the same offence within the timeframe set by the first judge then the next judge adds the original sentence to your one for the new offence.

I'm not an expert, but I thought that was the basis of the suspended sentence over here too. Although it's not really ever invoked.

Aye, "within the time frame". I'd be surprised if our man Mick's suspended sentence, from years back, hasn't passed its Sell-By date.
One can only hope the prosecutor knows their stuff, and can draw the complete picture for the judge.

Once upon a time it meant you were hanged. It's a bit more lenient now.

 

If he commits another offence before the suspended sentence has expired, any offence, the suspended sentence can be activated and he gets banged up.

I've just looked it up, and indeed his 2020 conviction was suspended with a two-year time frame.

This guy has been at it for more than 35 years, spent six months in prison in '89, and already in 2020 had roughly ten convictions - maybe more in the mean time.

He's not gonna stop.

Sadly a judge will have to go by the guidelines and it is likely that all of his past, spent convictions won't be taken into account because of the timeline.  TBH that is probably why he is being taken to court for such a small time frame; were they to actually act upon some of his actions documented on here, then he'd be in the realms of committing crimes whilst still serving his 2 year suspended!  His solicitor has likely come to an agreement that they'll not contest the action if he is only tried for a small number of cases in a recent time frame!

Unfortunately the prosecutor will probably see the file of evidence for the first time on the morning of the hearing and will have time to read the summary of evidence and skim the key witness statements along with whatever other cases they pick up that morning. I wish I was joking!

So this is more serious then? A trial suggests he’s going to have to face a more serious punishment than a slap on the wrist like last time.

 

I’m sure he won’t get a custodial sentence…

This is where I think he's being clever; take the guilty plea for a few crimes, in a short time frame and not get it to open court where other misdemeanours could be dragged up.

Another option would be to plead guilty and ask for 9000 other offences to be taken into consideration, as then he couldn't subsequently be tried for those. It's always possible that the police are keeping everything else up their sleeves to see what becomes of this case. Or alternatively they've lost all the paperwork for all the fraud cases that have been reported to them.

It is not unknown for police to work up a 'Representative Sample" of cases for a longtime perp to plead guilty on, public knowledge as we have seen. I don't know if that then includes the entire case file of open cases getting presented to the judge or it is coded language that everyone understands, used to save court and police resources.

 

I believe there is the expectation that there is enough in the representative sample to get a good jail term by themselves. Perp expects a little leniency for having plead guilty but alternative is going down for the lot so not much discount.

I think, from memory, he’s the guy running the bands.

It may be that he’s a nice guy who’s fun to be around and pays well for the band.
 

Confidence criminals can be quite lovely people, it’s the reason they can be successful.

Personally I'd have a hard time playing in a band with a guy that's been ripping off other musicians. Maybe they don't hear from bass players he's stolen from.

I completely agree.

 

This fella is a committed criminal who continues to offend. He’s a scumbag. 

 

I am playing in a band later with someone who was convicted of robbery. He was more a victim of circumstance and it was 30 years ago. Guess you have to believe in the capacity for change.

 

My dad’s house was repointed by a childhood friend who went to prison for attempted murder. A lovely fella who had a breakdown and did something entirely out of character.
