I agree in principle, but it's a very big 'if', especially when you can show the court all your quality system documentation and the test certificates from independent test houses etc etc. Sure, sh1t can still happen, but proving negligence against such a background will be a very difficult, time-consuming and costly business . . . which is probably why product liability insurance isn't really all that expensive to buy in the first place.
I would not argue negligence , just arguing that if their product had caused damage or injury they would be liable for more than the cost of replacing their product.
. . . in the real world they will have had the item independently tested and certified as being compliant with the relevant product standards. This, together with their ISO9000 manufacturing quality system, will be their defence against any negligence claims. If manufacturers were liable for consequential damages, their products would be unaffordable because they'd have to insure against potentially infinite (well, almost!) claims at an astronomical cost, making product manufacture an uneconomic proposition.
All well and good , but if a dodgy one comes off the production line on a friday afternoon shift and causes an issue , if it can be proved , then they will be liable , despite all the bits of paper that say how good the thing should be . Companies have liability insurances for a reason Consequential damages were always argued away contractually , and to a degree still hold up , but if they have a faulty product that gets through and cause injury or damage that can be proved it is a different story

Added Value , rather than cost , but yep , that is the sort of thing that will uplift a product's value by providing a service that is percieved as a need by the clients in the market

The dreaded question......................
lurksalot replied to The Admiral's topic in General Discussion
My Mrs has paid the deposit on a new bass I have ordered . It took me sooooooooooo long to pull the trigger because of the price, I loved her support when she said 'buy it', but somehow feel a little deflated that she is settling the CC bill of the deposit as my chrimbo pressy , it sounds really churlish , but I would rather she bought me a pack of picks rather than hijack my own purchase . I know she means well and will get me some great pressies , but sometimes the price is just not the issue. A mug, lanyard , BC stuff , The idea of a pressie is FAR more that they saw something and thought of you , and thus bought it, rather than asking what you want that you could easily buy for yourself . I have just shared the clearing the deceased MIL flat , and it is amazing how some of the most trivial seeming items evokes the most memories. -
Move south where its warmer and less damp , sorted. Alternatively , eat more garlic , wear a copper bracelet or take cod liver oil , better still do it all. good luck , a lot of it is how you handle it , an age is a number that is all , don't give in to a random number

I have replaced drivers and noticed them being 'tight' for a while and am familiar with the idea of letting them loosen up . What DOES surprise me , is that while it generally seems valid that drivers do come from the factory 'tight' , why don't the suppliers/ manufacturers offer the added value of loosening them up ? I know Guitards who look for 'old' greenbacks and the like because they already can produce the tone they expect, but that is my point . If you can sell brand new broken in drivers , there must be an added value for those that are looking for it

I have built a couple of mini tapped horns using Precision devices 12 inch subs (PD12 SB30) they sound great , but I am trying to build smaller , my next build will be to sort a sub for the kick drum , I am hoping to build a box not more than a foot cubed , but the proof of the pudding ........ maybe on my christmas break
I reckon you're in goodwill territory, depending on the nature of the fault. I doubt that manufacturers have any liability for consequential damages. Imagine if a house was burned down because of, say, a faulty toaster - do we really think the toaster manufacturer would be liable?
Quite possibly yes, if they could be proved negligent in the design or manufacture iof the toaster , but in the real world .......

Odd gig tonight , played a local gigging pub that was 'lightly attended ' we played well and our sound was pretty good , I guess the quantity of the crowd was balanced by the very kind and complimentary comments that they offered us . we have 2 parties pencilled in on the back of the gig (at good money) The really bizzare thing is that it is known as a rock pub ,so we built the set list to suit , but with only half a crowd we changed on the fly a fair bit and ended up with everyone dancing/ jiving and rocking , The best bit was that they said they loved the variety of Rock , pop , classic and oldies etc I guess that rather than rocking the place, we partied it .

Its nice to see Bass direct recomended , I have ordered a new Spector from them , I was given their details from the importers and have to say Mark has been very helpful, thorough and prompt, even just dealing via email. Suffice to say the deal was decent aswell.
Does that mean if you're not on Facebook or Twitter you might be at a disadvantage?
I am not sure of the detail but I get the impression that the links to social media sites may influence the voting for mates , hence the massive vote increase intimated earlier. how many times do we see 'vote for me on facebook' etc this time it may have happened in reverse

How many mistakes per gig do you make?
lurksalot replied to The Dark Lord's topic in General Discussion
some fantastic stuff here , I am mostly guilty of forgeting to retune after a drop D tuning , then playing into 'going underground' ,the stress of relearning the fretting on the E string on the fly, borders on the edge between wired and shitting yourself . Oh and starting tenpole tudor in A instead of B , but I always notice before everyone else comes in and pretend its a run up when they do -
Would you buy a bass or amp from Tesco?

OK then , someone had to do it ....... -
I know the thread's drifted off it but I just thought I'd clear up the initial point, Muse do not mime (apparently the Olympics performance was mimed as they all were but that's the only exception). Bellamy has a habit of singing far from the mic and his vocals set up is geared to compensate for it, they use a mic with a long range, run it through a compressor, adjust the gain manually etc. Perhaps more to the point though, I thought Jools had a blanket no miming policy?
Cheers Bob , I guess it is a lot of component trickery , it just didn't seem right , when you hear something and see something and it doesn't quite compute IYSWIM .

lurksalot replied to Skol303's topic in General Discussion
This is not just a pop in and vote , the compositions and production is incredible , fantastic stuff and well worth the time to investigate . -
Awesome collection of entries , just incredible , and am totally confused how to vote , so I will have to start a score card system , which means I will have to listen all over again .......and again.......and again

Don't buy it just because it a bargain , buy it if you'll use it , and I have to say it is VERY useable.
is whether or not I have the option to constantly run a dry bass line signal. theres plenty outputs and no doubt I can do it via the 2 XLR outs, but I was hoping I could run a single line into my amp,
This can certainly be done using the Mono XLR channel , with the pre - effects button activated , you could probably have a cable adaptor to jack for the amp .

a couple of gigs ago our lead guitars wife came along, wanting to impress ,he put on a show ........only to be told by his Mrs he was too loud , what a beautiful sulk . Our guitarists are generally really good , it is just a question of getting them to remember that the vocal needs a bit of space when its his turn
