  1. I think we're slightly talking at cross purposes - but in the sections I quoted, "ownership" is transferred when the contract is made, which would be when the funds are transferred in the absence of anything agreed to the contrary.
  2. That does sound intuitively correct, but at the risk of diverting the thread slightly, it's wrong The relevant sections of the law are ss16 - 20 of the Sale of Goods Act 1979. Essentially s18 sets out the rules to ascertain when property (i.e. ownership) in goods is intended to pass. Rule 1 states that property passes when the contract is made. S20 states unless otherwise agreed, the risk remains the seller's until property i.e. ownership is transferred to the buyer irrespective of whether or not delivery has been made.

If the transaction is between two private individuals then it depends on what was explicitly agreed in the terms of the sale, but in the absence of any express agreement it is arguable that risk passes with payment. If the sale is by a business to a consumer, then you are correct.

  14. Did a gig on drums in Italy many years ago on an outdoor stage. The performance area was covered but open at the back. There was a deluge as we were playing, and I look over to see water pouring in huge sheets off the back of the roof, directly into one of the stage boxes into which all the amps and equipment were plugged, and all across the floor of the stage while we're all playing away. Cue panic from me mid song, trying to attract the sound guy's attention and that of the rest of the band, which was quickly focussed when one of the amps went 'bang', leading to a very rapid stage abandonment!

  21. My cat used to climb inside the bass drum of my drum kit to lie on the pillow in there. She got the shock of her life when I hadn't noticed and started playing!
  22. I have a G&L bag that came with a bass. It's fantastic, well padded and has a large pocket which should fit a head in. Worth a look if you can find one.
  23. And (as a currently practicing solicitor) the analogy drawn with cars is erroneous, as there is specific legislation which deals with vehicles sold without notice of a finance agreement. The legal principle is 'nemo date non quod habet' which means that a vendor cannot sell what he does not have good title to. There are various statutory and case law provisions relating to this but in general the innocent buyer cannot acquire good title in stolen goods.

  25. I should just clarify when I said preamp I meant an onboard one to turn the bass active. In my case I fitted a Glockenklang which was ideal as it mirrored the functions of an active Streamer, but (provided you can get it to fit) any onboard pre would do.
