That may have been the case some time ago, but in the modern world we have become litigious with law firms constantly encouraging us to take action when, not only did we realise we had not been wronged, but in some cases the only winners are the lawyers. "Come and get something for nothing and we will only take a fee if we win" adverts are everywhere. And yes, some accountants exist solely to find loopholes in new tax legislation, just as some plumbers profit from new regulations. The difference is that those tax arrangements and regulations change in principal to fund public service and protect consumers. Law develops through aggressive litigation that benefits few other than the lawyers. Are you a lawyer by any chance?
  2. It's been a complete waste of time for ES. The lawyers however will have pocketed quite a few pennies so it's not a waste of time for them and the precedent set will allow them to make much more money in the future arguing whether this precedent applies to the next case they bring. Whilst I agree with your summary the claim related to a specific section of the song and the similarities noted by the judge are specific to use of a fairly common progression consisting of 1 min3, 4, 5. The precedent set is that common standard progressions are no longer covered by IP - and that's probably how it should be.
  3. Really? The case was brought by Sheeran in response to Switch having notified the PRS that he wanted part credit for the song. Clearly this was an attempt to claim royalties and it's only by bringing the case that Sheeran could have the claim as co-writer dismissed. Or am I missing something?
  4. 20 years ago I wrote and recorded a song and shortly after Pulp released something where the melody was identical. Lately I wrote a song and not long after heard something by Florence and the Machine which had a similar melody. Pulp didn't nick my song - it never got past me playing it on a cassette to a handful of people, but I still don't know if I subconsciously stole from Flo. It's some kind of modal melody and not really something that crops up that frequently in pop.
  5. My tone is like Long Island Iced Tea, superficially sweet and tasty but packing a surprising edge that you may regret in the morning.
  6. Now surplus to requirements this cabinet is lightly used. There are a few scrapes on the top as per the 2nd pic, but otherwise as new.   7. I tried a daisy chain on my small pedal board (4 pedals) and the noise was horrendous. A guy in the local shop pointed me in the direction of Xvive and it's been fine at a pretty low cost compared to some alternatives.   9. Every month I think I've created something that might just top the vote and everyone else ups their game. Fair play to everyone.
  10. I generally eat a lightish meal a few hours before the gig, which plays havoc with my system as my normal evening meal would be at around 8.30pm. If I'm driving I might have one beer at the gig. When I get home I'll have another beer or two and a bag of crisps, or if I'm really hungry a marmite sandwiich.
  11. Here is this month's contribution. Inspired by the Latin name for the daffodil, Narcissus which led me to write something about those people that rate themselves too highly. Technical - I was a bit pushed for time this month after abandoning an all electronic track that started OK and fell off a cliff so I went back to my last song of a similar genre and copied the project for all of the settings. I tweaked them a bit but they suited the song and it saved a heap of time. It's a Fender Tele and Squier PB all via Amplitube 5. MT power drums. I forced myself to be a bit more confident with the vocals - they're still very shaky but I think singing with a bit more effort improves them a little - just a touch of reverb and EQ from Cubase helps polish the turd.

  13. I've never played in an originals band but write and record my own stuff at home which virtually no one listens to. I mostly find that I don't push my abilities that much when writing my own stuff. Playing covers forced me to learn to play things that were difficult sometimes and made me a better player. I didn't really enjoy gigging that much - it was a necessary evil of being in a covers band but I enjoyed being in a room with other people just to make music - whether it was someone else's or not was irrelevant, and the reaction of an audience to a song they know is satisfying. The hardest thing about being in a covers band is getting everyone to agree what covers you're going to play, or having to play songs that you simply don't like while pretending that you do. I struggled with the idea of being a musician while not actually creating anything of my own but overcame that very quickly. The vast majority of musicians though history have played other peoples compositions whether that be orchestral, jazz standards, traditional folk songs or whatever.
