And why that sentenced opened with the word "if", as I was simply illustrating a point, re reasonable description and reasonable expectation. Actually, within the UK, "not proven" as a verdict is only competent in Scotland, not South of the Border. Have to agree, though, that the lapse of time makes attempting to stand on the usual rights reasonably enforceable against a trader/manufacturer unreasonable against a private individual.

It is always advisable to seek confirmation of operative/cosmetic condition, making any statements issued conditions precedent of any sale. Of course, between private individuals not carrying on sales by way of business or trade it can be problematic obtaining redress where the subject of a sale is not as described or expected. That said, within a community such as BC, one would hope that a more equitable approach to disputes would be possible. When private individuals deal, however, the doctrine of caveat emptor (buyer beware) should be remembered.

To describe an item as "new in box" that establishes a reasonable expectation on the part of a potential buyer, that the item is unused. However, this was not the case. The pickup had been previously installed (during which time it is claimed it operated). It was then removed (during which process it is entirely possible it could have been damaged). It was then advertised as new and boxed. If Sid were a trader, and I were Trading Standards, I could achieve a successful prosecution for misrepresentation.

  8. Probably 4001. Probably '70s. Probably Japanese. Given that the group of Japanese factories making Ric copies were buying in hardware and components from the same sources it's incredibly difficult to say with absolute certainty where any Ric copy was made. You can pin things down to possible sub-groups, such as those factories which were known to use Maxon pickups, so if the pickups have any of the markings known to be used by Maxon ... The TRC could have been of assistance, if it had a factory name, but not if it had an own-brander mark. The own-branders, such as Ross Morris, bought from multiple sources. Yours appears to be a neck-through, which is a sign of quality. Lots are bolt-on. A couple of the bigger factories doing neck-through were FujiGen (for Ibanez) and Matsumoku (for Aria). But both those factories were known to serial number their production, so it's unlikely to be either of those facilities. But even that's by no means definitive. The main sources of information will be pickups and pots, if these are original.

It's certainly the case that some were plywood/butcher's block, but not all. My first bass was a Columbus Precision, with what initially appeared to be a three-piece body, but was in fact a six-piece body (two layers each with three pieces). Most commonly the examples constructed with larger timbers were Sen (ash), Nyatoh (mahogany), and Agathis.

    Well, when resting, the string is taken slightly out of tension, and when picked up put back under full tension, and that change is enough to cause what you're observing. Humidity/moisture could certainly be an issue, but for it to be happening every day, assuming that the environment is otherwise staying stable, I'd say that would be unusual.
  11. I'm assuming you've asked the seller if he knew the pickup was faulty when he sold it? My own experience of BC when an item turns up faulty or damaged isn't too good. On both occasions I was prepared to accept that the goods had been damaged in transit. On both occasions the BCers agreed to cover the cost of repairs. On both occasions I provided the BCers with estimates and/or receipts for the work done, as well as numerous photographs of the damage for their insurance claims. On neither occasion did the BCers honour their agreement to reimburse the cost of repairs. One left me £240 out of pocket, the other £35. Other BCers have had more success getting more equitable outcomes. You should discuss the situation further with the seller. If you're not satisfied after those discussions, use the feedback thread to highlight the conduct of the seller.

    If you mean hard case then chances are the neck is resting against a support/internal divider in the case, and that's enough to do this. Even standing in a rack with the neck cradled is enough to do this. Probably why, first thing I do when I pick up a guitar/bass is check the tuning.

[/quote] The original "Hondo" was the "brand name" under which the International Music Corp (IMC) and Samick (SMI) joint venture operated. It was a corporate entity in its own right, but it didn't own any facilities, and was initially a distribution agreement before being an own-branding manufacturing venture.

The manufacturer of Hondo/Hondo II branded instruments was Samick, which had its main facilities in South Korea, but also operated a facility in Japan. There are many who suggest Tokai produced MIJ Hondo, although there is not a lot of hard evidence to support that. One of the main Japanese manufacturers operated the other way, with a subsidiary facility in Korea was Tokai, with others including ESP and Kawai. After the closure of the Matsumoku facilities, and the first phase of production by FujiGen, Samick was responsible for manufacturing for Aria. It produced in both Korea and Japan, and while doing this it's known that Samick did not put serial numbers on its output, between '89 and '92, except for those instruments where a sticker was put under bridge assemblies. Oddly Tokai adopted a similar approach with some of the models it produced in Korea, not marking the product MIK or adding serial numbers. This approach can also be found on Washburn branded instruments produced between '88 and '92/'93.

Somewhat surprising, wouldn't you say, for a man who we're told is the friend, and advocate for the rights, of the workingman? Springsteen certainly wasn't showing much respect for others, or right. And it's wonderfully naive of you to focus your attention on one aspect of the decision, as if there would simply be one category of concern for the concert venue on the night. Is Mr Myers also an expert on public order issues? Is Mr Myers also an expert on the working time regulations issues? Is Mr Myers also offering expert comment on the civil and criminal liabilities of the concert organisers? Or was Mr Myers' the knee-jerk defence of an area of regulation which comes in for regular criticism in society, whose comments are biased from his own personal experience and disappointment on the night?

  17. The Altamont free concert, in 1969, arguably, falls into a different category. Although, that said, it does demonstrate what can happen when security/supervision isn't properly handled. In that case, out of a crowd of circa 300,000, one murder, three accidental deaths, significant numbers of injured, and Mick Jagger being punched in the face. The Duisburg Love Parade, in 2010, is possibly a better example of what happens in a situation where a large number of people are not properly supervised. There, out of a reported attendance in excess of one million, 21 people died, with the injured being in mid hundreds, when a large crowd attempting to both access/egress through a single tunnel stampeded.

In the cynical world in which we now live, saying an item is "new/boxed" would be a good excuse/defence for avoiding liability for selling goods which turned out to be faulty.

But how exactly would the venue have known that it was the performers intention to end at that point? The performers had already indulged in a substantial overrun, and comments on social media circulated afterwards by one of the guitarists indicates there was an intention to play a third song. There comes a point where the cutoff has to be enforced, and that point was reached. Re your attendance at a concert, and your journey home. Clearly you were in the fortunate position to both know and use certain of the available transport links to return home. Not all concert attendees out of an audience of 80,000 would be in your fortunate position. Not all would be travelling short distances home. Not all would have the requisite knowledge of alternative travel options should their primary travel option not be available. Releasing 80,000 persons into a location at a late hour, without appropriate access to travel from the location is a health and safety concern, as well as a public order concern. Those organising such events as an outdoor concert for 80,000 have a duty of care to all attendees, not just those who live close to the area and have a short distance to travel home.
